1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Birchgrove Inc., operating as Dr. Jill Birch and The Relational Leadership Academy("we," "us," or "our"). By accessing or using our platform at drjillbirch.com, including the Masterwork Curriculum, Reflections feed, Student Console, and all related digital services, you agree to be bound by these Terms.
If you do not agree to these Terms, you must immediately cease all use of our platform. We reserve the right to modify these Terms at any time, and your continued use constitutes acceptance of any modifications.
2. Intellectual Property Rights
2.1 The Masterwork Curriculum
The Masterwork Curriculum, including but not limited to all course modules, lesson plans, assessment frameworks, leadership models, relational theory frameworks, video content, written materials, and supplementary resources, is the exclusive intellectual property of Dr. Jill Birch and Birchgrove Inc. All rights are reserved under United States and international copyright law.
- No portion of the Masterwork Curriculum may be reproduced, distributed, transmitted, displayed, published, or broadcast without prior written consent from Birchgrove Inc.
- Students are granted a limited, non-exclusive, non-transferable, revocable license to access curriculum materials solely for personal educational use during their active enrollment period.
- Screenshots, screen recordings, PDF exports, or any other form of content capture of curriculum materials for redistribution are strictly prohibited.
- The "Compassion Advantage" framework, relational leadership models, and all associated terminology are proprietary to Dr. Jill Birch.
2.2 Reflections Feed Content
All articles, essays, research summaries, and commentary published on the Reflections feed are authored by Dr. Jill Birch, Clayton Birch, Cheryl Durand, or authorized contributors and remain the intellectual property of their respective authors and Birchgrove Inc.
- You may share Reflections articles via the built-in social sharing tools (LinkedIn, X, Facebook) with proper attribution.
- Reproduction of full articles, excerpts exceeding 200 words, or derivative works requires written permission.
- Curated external scholarship linked through our platform remains the property of its original authors and publishers.
3. User Accounts and Conduct
3.1 Account Responsibilities
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
- You are solely responsible for all activity that occurs under your account.
- You must immediately notify us of any unauthorized access to or use of your account.
3.2 Acceptable Use
When using the platform, including the Reflections feed comment system and messaging features, you agree not to:
- Post content that is defamatory, harassing, threatening, obscene, or otherwise objectionable.
- Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
- Upload malicious code, viruses, or any material designed to disrupt or damage the platform.
- Attempt to gain unauthorized access to any portion of the platform, other user accounts, or related systems.
- Use automated tools, bots, or scraping mechanisms to collect platform content or user data.
- Engage in any activity that violates applicable local, state, national, or international law.
3.3 Content You Submit
By submitting content (including course assignments, comments, and messages), you grant Birchgrove Inc. a non-exclusive, worldwide, royalty-free license to use, display, and store such content for the purpose of operating and improving our platform. You retain ownership of your original submissions.
4. Enrollment and Payment
- Course enrollment and associated fees are as described at the time of registration. All fees are in USD unless otherwise stated.
- Payment is processed securely through Stripe. Birchgrove Inc. does not directly handle or store credit card information.
- Refund requests are evaluated on a case-by-case basis. Please contact us within 14 days of enrollment for refund eligibility.
- We reserve the right to modify pricing for future enrollment periods with reasonable advance notice.
5. Platform Availability
We strive to maintain continuous platform availability but do not guarantee uninterrupted access. We reserve the right to perform maintenance, updates, and modifications that may temporarily affect availability. We are not liable for any loss or inconvenience arising from platform downtime, whether scheduled or unscheduled.
6. Credential Verification
Upon successful completion of the Masterwork Curriculum, students may receive digital credentials or certificates of completion. These credentials:
- Are issued at the sole discretion of Dr. Jill Birch and the Academy administration.
- May be verified through our Credential Vault system.
- Do not constitute academic degrees, professional licenses, or government-recognized certifications unless explicitly stated.
- May be revoked if the Terms of Service are violated or if academic dishonesty is discovered.
7. Termination
We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that we determine violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination:
- Your access to the platform and all course materials will be revoked.
- We may retain your data as required by law or for legitimate business purposes.
- Provisions of these Terms that by their nature should survive termination shall survive.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Birchgrove Inc., Dr. Jill Birch, and their respective officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from or related to your use of the platform.
Our total aggregate liability for any claims arising from or related to these Terms or your use of the platform shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
9. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in the State of Florida.
